1. Agreement to These Terms
These Terms of Service govern access to and use of BuilderStudio, including our website, applications, canvas and workflow tools, APIs, MCP surfaces, integrations, billing features, generated content, and related services.
BuilderStudio is operated by a Delaware C corporation. In these Terms, "we," "us," and "our" refer to BuilderStudio and the company that operates it.
By creating an account, accessing BuilderStudio, or using the service, you agree to these Terms. If you use BuilderStudio for an organization, you represent that you have authority to bind that organization and its authorized users.
If you have a signed order form or other written agreement with us, that agreement supplements these Terms and controls only where it expressly conflicts with these Terms for the covered service.
2. Accounts, Workspaces, and Access
You must provide accurate account information, keep it current, and be legally able to use the service. You are responsible for safeguarding passwords, sessions, API keys, OAuth connections, provider credentials, and workspace access.
- You are responsible for activity under your account and workspaces, including activity by invited members, connected integrations, automations, API keys, and MCP clients.
- Workspace owners and administrators are responsible for member permissions, offboarding, billing administration, connected services, and content shared inside or outside a workspace.
- You must promptly notify us if you suspect unauthorized access, credential compromise, workspace misuse, or a security issue affecting the service.
- We may require verification, additional security steps, or administrative approval before restoring access, changing account ownership, or making workspace-level changes.
3. Content and AI Outputs
Your content includes prompts, instructions, files, media, code, documents, canvas state, workflow configuration, imported data, generated outputs, published sites, form submissions, and other material you submit to or create with the service.
- You retain ownership of your content. You grant BuilderStudio the rights needed to host, process, transmit, reproduce, display, adapt, and otherwise use your content to provide, secure, support, and improve the service.
- You are responsible for having the rights and permissions needed to submit content, connect data sources, run workflows, publish sites, export code, or share outputs.
- AI and automation outputs may be inaccurate, incomplete, offensive, duplicative, or unsuitable for your use case. You are responsible for reviewing outputs before relying on them or publishing them.
- Do not treat outputs as legal, medical, financial, safety, employment, or other professional advice. Use human review where a decision could affect rights, safety, finances, access to services, or legal obligations.
- Public pages, published sites, templates, shared links, workspace invites, and external exports may make content visible to others. Review permissions and content before sharing.
4. AI Providers and Third-Party Integrations
BuilderStudio connects to third-party services, including AI model providers, media-generation providers, payment processors, hosting and storage services, Google Workspace, GitHub, webhooks, API clients, and other integrations you authorize.
- When you choose a model, integration, export, import, or webhook, your content, metadata, credentials, and request details may be sent to the selected third-party service to complete the action you requested.
- Third-party services are governed by their own terms, policies, permissions, pricing, rate limits, availability, model behavior, retention rules, and security practices.
- If you bring your own provider key, your use of that provider is between you and the provider. Provider charges, quotas, account status, and policy restrictions may apply independently of BuilderStudio billing.
- You may not use integrations to bypass provider rules, send data without permission, violate third-party rights, or make us responsible for obligations you accepted with another service.
Our current subprocessor and customer-directed integration list is available on the Subprocessors page.
5. Acceptable Use
You may not use BuilderStudio to violate laws, infringe rights, compromise security, abuse third-party services, or interfere with the operation of the platform.
- Do not attempt unauthorized access, probe or scan systems without permission, bypass authentication, evade rate limits, scrape protected surfaces, overload infrastructure, or disrupt service availability.
- Do not submit, generate, publish, or distribute unlawful, abusive, deceptive, exploitative, harassing, hateful, defamatory, infringing, sexually exploitative, violent, or otherwise harmful content.
- Do not create or distribute malware, credential-harvesting flows, phishing pages, spam, fraud, impersonation, disinformation campaigns, or tools for evading detection, safety systems, or platform policies.
- Do not use the service for decisions or workflows that require regulated professional judgment, safety-critical review, emergency response, or legally required human oversight unless you independently provide that review.
- Do not resell, sublicense, rent, lease, or provide managed access to the service except through an arrangement we authorize in writing.
6. API, MCP, Automation, and Security
Programmatic access must be used only through supported interfaces, documented scopes, and workspace permissions. You are responsible for all requests made with credentials issued to your account or workspace.
- Keep API keys, bearer tokens, OAuth grants, webhooks, and provider credentials confidential. Rotate or revoke them promptly if they may be exposed.
- Do not share credentials across unrelated organizations, embed secrets in public code or public content, or use automation to exceed documented or reasonable operational limits.
- We may throttle, limit, suspend, revoke, or require remediation for programmatic access that creates risk, degrades reliability, violates these Terms, or appears compromised.
- If you believe you found a vulnerability, report it to legal@builder.studio and avoid accessing, modifying, deleting, or disclosing data that is not yours.
7. Plans, Billing, and USD Balances
Paid features may require a subscription, usage-based charges, a workspace USD balance, one-time top-ups, promotional grants, taxes, or other fees. Pricing, limits, renewal terms, and billing intervals are presented at checkout, in your account settings, in product notices, or in an applicable order form.
- Subscriptions renew automatically until canceled. You can cancel through the billing flow we provide or through the payment processor portal when available; cancellation generally takes effect at the end of the current billing period unless stated otherwise.
- Built-in-provider workflow executions and direct provider operations may consume workspace USD balance after vendor usage is recorded. Bring-your-own-key runs may still be charged by the external provider, but are not charged by us for the provider cost we did not incur.
- Promotional grants are not cash, are not transferable, may expire or reset by plan cycle, and have no refund value. Purchased top-ups are for use inside the service and are not bank accounts, stored-value accounts, or cash equivalents.
- Usage estimates may differ from final settlement because provider rates, metering units, retries, model behavior, and taxes can vary. Vendor pricing and model availability may change.
- Except where required by law or expressly stated at checkout or in an order form, fees, consumed usage, and promotional balances are non-refundable. Failed payment, chargeback, fraud review, or unpaid amounts may result in suspension or downgrade.
8. BuilderStudio IP and Feedback
BuilderStudio, including its software, interfaces, design, branding, documentation, templates, platform content, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.
If you send ideas, requests, comments, bug reports, designs, or other feedback, you grant BuilderStudio a perpetual, worldwide, royalty-free right to use it without restriction or compensation, while you retain any rights you already had in your own materials.
9. Privacy and Confidentiality
Our handling of personal information is described in the Privacy Policy. You are responsible for providing legally required notices and permissions for personal information you submit, connect, import, process, publish, or disclose through the service.
We use reasonable safeguards and access controls designed to protect private workspace content. We may access, use, or disclose content where needed to provide the service, support users, maintain security, comply with law, enforce these Terms, or respond to abuse, safety, or rights-related concerns.
10. Availability, Changes, and Beta Features
We may update, modify, suspend, limit, or discontinue features from time to time, including provider integrations, models, workflow capabilities, APIs, MCP tools, plans, quotas, and beta or experimental surfaces.
We do not guarantee uninterrupted, error-free, or permanent availability. Maintenance, provider outages, network issues, abuse prevention, security incidents, capacity limits, or product changes may affect access, workflow execution, storage, generated outputs, or published sites.
11. Suspension and Termination
You may stop using BuilderStudio at any time. We may suspend, limit, or terminate access if we believe you violated these Terms, created risk for the service or other users, failed to pay amounts due, used the service unlawfully, or caused us or a third-party provider to face legal, security, operational, or reputational risk.
After termination, your right to use the service ends. We may preserve, delete, or make available content according to the Privacy Policy, product capabilities, legal obligations, security needs, backup integrity, and any applicable written agreement.
12. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.
We do not warrant that outputs will be accurate, unique, lawful for your intended use, free of third-party rights, secure, available forever, or suitable for regulated, professional, or safety-critical use.
13. Liability Limits
To the extent permitted by law, BuilderStudio and its affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, replacement services, or procurement costs.
To the extent permitted by law, our total liability for all claims relating to the service is limited to the greater of the amounts you paid to BuilderStudio for the service giving rise to the claim during the 12 months before the event giving rise to liability, or USD $100.
14. Indemnification
To the extent permitted by law, you will defend and indemnify BuilderStudio and its affiliates, suppliers, licensors, service providers, officers, directors, employees, and agents from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your content, your use of the service, your integrations, your violation of these Terms, or your violation of law or third-party rights.
15. Governing Law, Venue, and Disputes
Before starting a formal claim, you agree to contact legal@builder.studio with a brief description of the issue and give us a reasonable opportunity to resolve it informally, unless emergency relief or applicable law requires otherwise.
These Terms and any dispute arising out of or relating to these Terms or the service are governed by the laws of the State of Delaware, excluding its conflict-of-law rules.
Except where applicable law requires otherwise, or where an applicable signed agreement states otherwise, the state and federal courts located in Delaware will have exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or the service. You and we consent to personal jurisdiction in those courts.
Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property, confidential information, platform security, or against unauthorized access, abuse, or misuse of the service.
These Terms do not require arbitration unless you separately agree to arbitration in a signed written agreement. Nothing in these Terms limits rights, remedies, venues, or protections that cannot be waived under applicable law.
16. Changes to These Terms
We may revise these Terms periodically. Updates will be posted on this page with a revised "Last updated" date.
If a change materially affects your rights or obligations, we may provide additional notice through the product, by email, or by another reasonable method. Continued use of BuilderStudio after updates become effective constitutes acceptance of the revised Terms.
